Acceptance and eligibility
These Terms of Service (“Terms”) govern your access to and use of the Fireship.ai website, dashboard, cloud services, companion software, connected-device features, and related services (collectively, the “Service”). By creating an account, purchasing the Service, or using it, you agree to these Terms and our Privacy Policy.
You must be at least 18 years old and able to form a binding contract. If you use the Service for a company or other organization, you represent that you have authority to bind that organization. If you do not agree, do not use the Service.
Accounts and workspaces
You must provide accurate account information and keep it current. You are responsible for safeguarding account credentials, controlling workspace membership, and promptly notifying us of suspected unauthorized use. Actions taken through your account or workspace are treated as authorized by you unless law requires otherwise.
Workspace owners control connected devices, billing, provider keys, privacy requests, support access, and member permissions. Administrators and members must act within the authority granted by the owner.
Connected-device authorization
You may connect Android phones and allow the Service to queue commands, operate supported apps through granted device permissions, collect operational results, and display requested live-view information. You represent that you own each connected Android device or have the owner's permission to control it.
You are responsible for the physical security, connectivity, operating system, installed apps, permissions, logged-in accounts, mobile plan, and safe placement of every device. You may disconnect or revoke a phone from the dashboard, but previously completed actions cannot always be undone.
Acceptable automation use
You may not use the Service to:
- Break a law, regulation, court order, contract, or third-party right.
- Access, control, monitor, or impersonate a person, device, or account without authorization.
- Send unlawful spam, harassment, threats, fraud, deceptive content, or malicious software.
- Collect, infer, expose, or exploit personal information without a lawful basis and required notices.
- Bypass security controls, rate limits, approvals, account restrictions, or platform enforcement.
- Interfere with the Service, probe it for vulnerabilities, reverse engineer protected components, or use it to harm others.
- Use automations for high-impact decisions about employment, credit, housing, insurance, healthcare, or legal services without appropriate human review and any legally required safeguards.
We may investigate suspected abuse and limit or suspend access where reasonably necessary to protect users, third parties, or the Service.
Third-party platforms and accounts
The Service can operate apps and accounts provided by third-party platforms. We do not control those platforms and are not responsible for their availability, rules, content moderation, account restrictions, interfaces, or changes.
You are responsible for complying with each platform's terms, community rules, advertising policies, rate limits, and applicable law. Fireship does not guarantee that a platform will permit a particular automation or that an account will remain available.
AI outputs and approvals
The Service may use AI-generated text, images, plans, classifications, screen interpretations, and suggested actions. AI output can be inaccurate, incomplete, biased, unsuitable, or similar to content generated for others. It is not professional, legal, financial, medical, or other expert advice.
You must review outputs and configure appropriate approval rules, schedules, limits, and account permissions before allowing consequential actions. Even when an approval mode is enabled, you remain responsible for content you approve, automations you activate, and actions performed through your connected accounts.
Subscriptions and PayPal billing
Paid plans are billed through PayPal at the price, currency, quantity, and interval shown before approval. Taxes may apply. By approving a PayPal subscription or top-up, you authorize PayPal to process the transaction under your agreement with PayPal.
Subscriptions renew until canceled. You can request cancellation through the billing controls available in the Service. Unless the checkout or applicable law says otherwise, cancellation stops future renewals and takes effect at the end of the paid period. Fees already charged are non-refundable except where required by law or expressly stated by us. Failed, reversed, disputed, suspended, or unverified payments may restrict paid features.
Managed credits and provider keys
Your managed credits measure eligible AI usage inside the Service. Credits are not money, have no cash value, are not transferable, and may be subject to plan periods or other limits displayed at purchase. We may correct a balance affected by error, reversal, fraud, duplicate credit, or chargeback.
If you use a bring-your-own-key route, you authorize Fireship to use the stored credential to send selected requests to that provider. You are responsible for the provider account, its charges, limits, security, and terms. Fireship credits generally do not cover charges billed directly by your chosen provider.
Your content and permissions
As between you and Fireship, you retain ownership of content and business information you submit, subject to any rights held by others. You grant us a worldwide, non-exclusive, limited license to host, copy, transmit, transform, display, and otherwise process that content only as needed to provide, secure, support, and improve the Service or comply with law.
You represent that you have the rights and permissions needed for the content, accounts, contacts, leads, and instructions you provide. You are responsible for reviewing generated content for accuracy, rights clearance, disclosures, and suitability before publication.
Fireship intellectual property
Fireship and its licensors retain all rights in the Service, including its software, interfaces, designs, documentation, trademarks, and technology. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to use the Service for your internal business purposes during your authorized subscription or access period.
Changes and availability
We may add, change, limit, or discontinue features; update supported apps, models, or plans; and perform maintenance. Phone automation depends on devices, networks, Android, model providers, PayPal, and third-party apps outside our control. We do not guarantee uninterrupted availability, compatibility with every device or app version, or successful completion of every automation.
Suspension and termination
You may stop using the Service at any time and may request account deletion through the available privacy controls. Ending use does not cancel amounts already due or automatically reverse completed external actions.
We may limit, pause, or suspend access when reasonably necessary to address security risk, nonpayment, legal requirements, harm, platform abuse, or a material breach of these Terms. We may terminate access for a material or repeated breach, or if continuing the Service would create unreasonable legal or security risk. Where practical and lawful, we will provide notice and an opportunity to resolve the issue.
Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available.” Fireship disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade. Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.
Limitation of liability
To the fullest extent permitted by law, Fireship and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, opportunities, account access, or business interruption arising from or related to the Service.
To the fullest extent permitted by law, Fireship's aggregate liability arising from or related to the Service will not exceed the amount you paid to Fireship for the Service during the six months before the event giving rise to the claim. These limits do not apply where liability cannot lawfully be limited.
Indemnity
To the extent permitted by law, you will defend, indemnify, and hold harmless Fireship and its personnel from third-party claims, losses, and reasonable costs arising from your content, connected devices or accounts, automations, violation of these Terms, or infringement of another person's rights. This obligation does not apply to the extent a claim results from Fireship's own unlawful conduct.
Changes to these Terms
We may update these Terms to reflect changes to the Service, providers, risks, or law. We will post updated Terms with a new effective date and provide additional notice when required. If you do not agree to a material update, you must stop using the Service and cancel future renewal before the update takes effect. Changes do not make training consent automatic.
